Terms and Conditions of Sale

These terms and conditions of sale ("Agreement") apply to all sales of TecheBOARD mini ITX motherboard ("Product") by Openteche.io ("Seller") through its website or other ecommerce platforms, including Amazon, Flipkart, eBay, etc.

Acceptance of Terms and Conditions

By placing an order for the Product, the buyer ("Buyer") accepts and agrees to be bound by this Agreement.

Order and Payment Terms

The Buyer shall place an order for the Product in accordance with the terms and conditions set forth on the Seller's website or the ecommerce platform where the Product is being sold. The Buyer shall make payment for the Product in full at the time of order.

Delivery Terms

The Seller shall deliver the Product to the address specified by the Buyer at the time of order. The Seller shall use its best efforts to deliver the Product within the estimated delivery date specified on the website or the ecommerce platform. However, the Seller shall not be liable for any delays in delivery due to unforeseen circumstances or events beyond its reasonable control.

Replacement Policy

The Seller does not accept returns of the Product. However, if the Product is defective due to manufacturing defects, the Seller will replace the Product within 7 days of the delivery date. The Buyer must notify the Seller of any defects within 7 days of delivery.

Warranty

The Product is covered by a one-year warranty from the date of delivery. The Seller warrants that the Product shall be free from defects in material and workmanship for a period of one year from the date of delivery. If a defect in the Product arises during the warranty period, the Seller will repair/ replace the defective Product.

Limitation of Liability

The Seller's liability for any claim arising out of or in connection with this Agreement or the Product shall be limited to the purchase price of the Product. The Seller shall not be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with this Agreement or the Product.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the US, without regard to its conflict of laws principles. Any dispute arising out of or in connection with this Agreement shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The place of arbitration shall be FL, and the language of the arbitration shall be English.

Entire Agreement

This Agreement constitutes the entire agreement between the Seller and the Buyer with respect to the sale of the Product, and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties.

Modification

This Agreement may not be modified except by a writing signed by both parties.

Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

Waiver

The failure of either party to enforce any provision of this Agreement shall not be deemed a waiver of that provision or any other provision of this Agreement.

By placing an order for the Product, the Buyer acknowledges that he/she has read, understood, and agrees to be bound by this Agreement.
